TICKET CYCLONE TERMS AND CONDITIONS

Please read carefully:

 

The following are the rules or “Terms” that shall govern use of the Ticket Cyclone web site. By using or making purchases on this site, you expressly agree to be bound by these terms that govern the site. Ticket Cyclone reserves the right to change these terms at any time, effective immediately upon posting updates to the site.

 

A) PURCHASING TICKETS

Ticket Cyclone is an independent, privately owned company, specialized in the business of locating, purchasing and selling event tickets that are typically unavailable through the original box office. Ticket Cyclone is not affiliated with any other box office, venue or Ticketmaster.com. Tickets sold on our site are procured by Ticket Cyclone on the open market from independent, professional, secondary ticket sources. Consequently, the ticket price that you pay will often be substantially higher than the price printed on the ticket. By making purchases on our website, you are acknowledging that tickets are priced higher than the actual face value, and agree to pay the price set forth by Ticket Cyclone.

 

B) RETURNS

Once an order is submitted and accepted, there are no refunds, exchanges, or cancellations. Upon receipt of an order, Ticket Cyclone will secure the tickets you have requested. Once these tickets are acquired, we cannot recover our obtaining costs, therefore, no refunds, exchanges, or cancellations will be allowed. For information on how to resell tickets on our site through our inventory system, please contact us customersupport@ticketcyclone.com or 214-257-0100.

 

C) EVENT CANCELLATIONS / POSTPONED EVENTS

If an event is cancelled for any reason, other than an act of nature (rainout, earthquake, flood, etc.) war, terrorism, strike, or lockout, we will provide a full refund for the amount of the tickets only. Shipping charges are not refundable. Tickets must received back in our office within 14 days of the event cancellation notice. It is strongly suggested that returned tickets be sent via Certified Mail or another service that will provide proof of delivery. Tickets that are lost in the mail cannot be refunded. In the case of a rainout or strike for a sporting event, no refunds will be made. You may exchange the tickets at the venue box office for a future available game. If an event is postponed, original tickets will be honored for the rescheduled event date. New tickets will not need to be issued. If you are not able to attend the event on the new scheduled date, no refunds are offered by Ticket Cyclone. We are unable to recover our original obtaining costs on tickets acquired for our customers, therefore, no refunds can be offered on postponed events. Ticket Cyclone assumes no responsibility for the actions of any event organizing body, performer, team, or venue when an event is cancelled or postponed, and therefore, has no obligation to refund incidental expenses (plane tickets, hotel reservations, rental car fees, etc.) that have been incurred relating to plans to attend the event. Any tickets return to TicketCyclone by the Customer or by Federal Express at the Direction of the customer, or any tickets return due to customer refusal to accept delivery will be resent to the customer at the customer expense. Customer’s credit card will be charged a new delivery fee of $25.00 for each new shipment attempt. If customer never accepts delivery of tickets the sale is still final and no refund will be issued, Any customer who attempts to fraud Ticket Cyclone by non-acceptance or unauthorized return of tickets and attempts to receive a chargeback thru the issuer of credit card use in transaction will be prosecuted for thief.

 

D) TICKET PRICING AND AVAILABILITY

All prices listed on Ticket Cyclone are in USD (US Dollars) and guaranteed only after orders are confirmed. Tickets are bought and sold on an open market; therefore, prices and availability are subject to change at any time. While our office is open six days per week, our online inventory system does not operate in “real time”. At times we may receive duplicate orders for the same set of tickets. In this case, the orders will be processed in the order of receipt. You will be contacted and offered the best alternative set of tickets that are comparable to your original seat selection and price. Since prices are fluctuating on the open market due to varying demand, these alternative tickets may have increased in price. You will have the option to pay the increased price or to cancel your order and your credit card will not be charged. Ticket Cyclone cannot guarantee the availability of specific sets of tickets listed on our website and prices are subject to change due to the supply and demand of each event. We will never charge more than you authorize, therefore, you always have the option to cancel the order should the price of your tickets increase before the order is processed. Ticket Cyclone cannot be responsible for typographical errors within the inventory listed for sale. If an error is found, you will be notified and offered other seating choices. If for any reason the tickets you selected are not available due to a listing error, you will be provided with equivalent or better seats available at the same price. You will also have the option to cancel your order. Since ticket prices fluctuate on the open market, you will never be asked to pay an increase of price on tickets you have already purchased. At the same time, we are unable to offer refunds, price adjustments, credits, or upgrades should ticket prices decrease prior to the scheduled event.

 

E) ORDER CONFIRMATION / PROCESSING

Upon submitting an order via our website, you will receive an automated e-mail notification that your order has been accepted for processing. This notification does not confirm ticket prices nor availability and only indicates our system has received your request for tickets. Please note that all orders must be manually processed by one of our sales representatives during business hours. Once an order is received, immediate action is taken to process your order and procure the tickets on your behalf. Once an order has been processed and confirmed, you will receive a confirmation and sales receipt sent to the e-mail address provided. NEVER assume an order has been processed or cancelled if this receipt is not received and call our office immediately for verification. Ticket Cyclone cannot be responsible for errors in e-mail addresses provided, and or internet provider filters, internet or electronic outages, or any third party software used for blocking SPAM. Please make sure your internet provider is able to accept e-mail from Ticket Cyclone and your settings are set accordingly in order to obtain your ticketing information promptly. Ticket orders received after business hours will not be processed until the following business day. Please do not place online orders for same day or next day events after business hours. As indicated above, tickets must be manually processed and tickets will not be received in time to attend your event. Your credit card will not be charged for orders we are unable to process due to delivery time restraints. When in question, please contact our office upon placing your ticket order.

 

F) CREDIT CARD PURCHSES

Purchases made by credit card do not grant any variances from our terms and conditions. Our terms and conditions must be complied with regarding all purchases made on our site. All credit card purchases will require processing through our address verification system. It is imperative that all credit card billing information is correct in order to obtain an approval on your card. A simple error could result in a declined response by our highly secure system.  Ticket Cyclone cannot be held responsible for declined transactions by issuing banks and cannot hold tickets due to non-approved cards. If your credit card information is declined by our verification system, we will attempt to notify you via the phone contacts you provide in order to review the information and or acquire an alternative method of payment. Ticket Cyclone will not be responsible for any increase in price or availability on the open market due to declined credit card transactions.  In such case, an attempt will be made to substitute the tickets or the transaction may be cancelled. All charges will appear on your billing statement as TicketTwister.com. Any attempt to defraud Ticket Cyclone using fraudulent information (credit cards, addresses, names etc.) may result in legal action against you.

 

G) SERVICE FEES

Each sale will include a service fee. This fee helps ensure that Ticket Cyclone is able to provide our customers with the best tickets prices in the industry. Tickets are often sold at our cost in obtaining them. The service fee will help offset the cost of securing tickets, credit card processing, shipping tickets, providing a secure website, and ensuring that all tickets are 100% authentic and guaranteed.

 

H) SHIPPING OPTIONS

Generally, tickets listed in our inventory are available for same day shipment; however, not all tickets will be available to ship the same day. Orders placed after business hours and on weekends will not process until the following business day. Since tickets are obtained from various sources, not all tickets are in hand and available to ship the same day. Many listings will contain estimated delivery dates in the note field. In some cases, tickets will not be available to ship until two weeks prior to the event date.  Once tickets are in hand and available for shipment, they will be sent by the method chosen at the time of order. When selecting your shipping option, please allow ample time to receive your tickets in time for your event, taking into consideration time of day you place your order, weekends, and possible weather delays. In the case an incorrect shipping method is chosen, Ticket Cyclone reserves the right to default to the correct shipping method and charge the appropriate fee. In some cases, tickets will be unavailable for shipment and must be picked up at the venue or designated location on the day of the event. This is called “WILL CALL” and will require photo identification for pick up. Ticket Cyclone does offer a 100% guarantee you will receive your tickets before your event date or we will issue a full refund.

 

I) E-MAIL TICKETS

Not all tickets are available in an e-mail format. Before choosing this method of shipment, please make certain the tickets are identified as E-Mail tickets, E-Tickets, or Ticketfast tickets in the note field. If unsure, please call our office for verification. Never assume orders placed after hours or on weekends will be e-mailed in time for the event.  When ordering e-mail tickets, you will receive two separate e-mails. One e-mail will contain your Ticket Cyclone sales receipt. The second e-mail will contain the tickets located in a PDF file which you will download and print. Tickets may be printed either in black and white or color ink. An automated order acceptance e-mail or a Ticket Cyclone sales receipt will not be allowed to gain entrance into any event. You must have actual tickets that are sent in PDF file form, containing a bar code used for scanning, downloaded and printed from your computer. Tickets should not be torn or altered in any way. If an e-mail shipping option is chosen, and tickets are not available in that format, Ticket Cyclone will default to the appropriate shipping method and charge the correct fee. If time constraints will not allow shipping, you will be contacted by phone with possible local pick-up options. Ticket Cyclone may require a credit card authorization form for e-mail tickets in order to provide a high level of security to our customers. In the event you have not received your tickets by email on the same day your order (or if order placed after hours, the next business day) contact our office at 866-398-3229 or if after hours our emergency number (only for same day events or events happing that day) 713-817-5794.

 

J) TICKET DELIVERY

We do not send tickets through the USPS Mail system. Tickets that are lost in the mail cannot be replaced or reissued; therefore, all tickets are delivered by Federal Express only and may require a signature for delivery. In order to provide our customers with the highest level of security, we will not deliver tickets to any address other than the actual credit card billing address on file with the issuing bank. This information is verified through our system at the time of authorization. Exceptions to this rule are at the sole discretion of Ticket Cyclone and may require a credit card authorization form for further processing. Federal Express will not deliver to a PO Box; therefore, a physical address must be supplied. You agree to provide us with a secure delivery location and authorize someone at that address to act as your agent in your absence to accept delivery of the package. By accepting a package from Ticket Cyclone, you are agreeing that you indeed purchased the contents of the package and are therefore, responsible for those contents until the date of the event.  Tickets that are lost, stolen, or damaged cannot be re-issued, therefore, please treat your tickets as cash and place them in a secure place until the event. For any discrepancy in the received contents, please contact our office immediately. In the case that tickets are non-deliverable due to an incomplete address provided, wrong address, new address or non attempt to reply to door notifications left by Fed-Ex, tickets will be returned to our office. We will attempt to reach you via phone before listing the tickets on our website for resale. Tickets that are non-deliverable cannot be refunded or exchanged.

 

K) LOST OR STOLEN TICKETS

Customers are responsible for their tickets once shipped and/or received. Tickets should be treated as cash and placed in a safe and secure place until the event date. Unfortunately, lost, stolen, or damaged tickets cannot be replaced or reissued. Tickets should not be stored in vehicles. Direct sunlight or heat could damage the tickets.

 

L) EVENT DATES AND TIMES

Event dates and times printed on the tickets are subject to change, especially sporting events. Due to the quantity of tickets and customers in our database, we are unable to automatically provide each customer with updated event times. Please check with your local media for any schedule changes to ensure you arrive on time for your event, or our sales representatives will be happy to assist you by phone with these requests. Ticket Cyclone is not responsible for event dates and time changes.

 

M) LIABILITY LIMITATATIONS

Ticket Cyclone is not responsible for transportation or travel related expenses to attend your event. We are not responsible to traffic, parking, long entrance lines, weather or any other delays that could cause you to arrive late or miss your event for any reason. We are not responsible for denied seating to theater shows or any other events should you arrive late. It is at the venues’ discretion whether to seat late arrivals and all venue policies must be adhered to. We are not responsible for customers that are refused entrance or removed from a venue due to irresponsible or inappropriate behavior, nor for any other reason. We are not responsible for denied entrance due to age restrictions. Age restrictions should be verified prior to purchasing tickets. Some material or themes may not be suitable for children or others. It shall be the customers’ responsibility to determine whether the content of an event is appropriate for all members of their party. We are not responsible for venue conditions, sound, offensive or obscene material, performer actions or the actions of the crowd at any event. All tickets are guaranteed to be 100% authentic and we do not sell duplicate tickets for the same event.  If someone is seated in your assigned seat, it is your responsibility to seek assistance from a venue usher. No refunds, credits or exchanges will be issued under any of the above circumstances.

By purchasing tickets, you acknowledge and concede that all transactions take place in Harris County in the state of Texas. In the event that Ticket Cyclone is required to seek legal action in order to recover fees, or resolve disputes, customer agrees that we are entitled to recover all costs associated with such action, including but not limited to reasonable attorney’s fees and administrative costs, within the jurisdiction of Harris County in the state of Texas.
